DESCRIPTION OF BANKRUPTCY
Chapter 7 Bankruptcy
– provides a fresh start with his or her credit by erasing most debt. People with large amount of unsecured debt such as credit card, personal and payday loans, utilities, cash advances, residual balances owed after vehicle repossession, garnishments and medical bills are typically good candidates for Chapter 7 Bankruptcy.
In most cases, the person filing may keep their home, car and other valuables.
Chapter 13 Bankruptcy
– provides individuals the opportunity to repay some or all of their accumulated debt through a court approved repayment plan. The Bankruptcy Court typically determines the repayment plan based on the examination of a person’s income and expenses. There is a determination of available money after all household expenses are paid for the court to determine the amount of available money for this repayment plan, after ongoing living expenses. A Trustee is appointed by the court. This Trustee accounts for each month’s payments and then disburses them directly to the creditors.
Chapter 11 Bankruptcy
- allows a business, whether a corporation, sole proprietorship, or partnership to reorganize their debt. A corporation exists separate and apart from its owners, the stockholders. The chapter 11 bankruptcy case of a corporation (corporation as debtor) does not put the personal assets of the stockholders at risk other than the value of their investment in the company's stock.
However, a sole proprietorship (owner as debtor) does not have an identity separate and distinct from its owner(s). Therefore, bankruptcy cases involving a sole proprietorship includes both the business and personal assets of the owners-debtors. Like a corporation, a partnership exists separate and apart from its partners. In a partnership bankruptcy case (partnership as debtor), however, the partners' personal assets may, in some cases, be used to pay creditors in the bankruptcy case or the partners, themselves, may be forced to file for bankruptcy protection.
